As senior litigation partner at Blaney McMurtry LLP, D. Barry Prentice acts as counsel for a broad range of clients both inside and outside the courts of Ontario.

"I specialize in employment litigation including corporate matters, shareholder and partnership disputes," he explains. "I'm also involved in commercial litigation and issues involving software – contracting, licencing and software disputes" He also acts as litigation counsel for another law firm in the Toronto area when it requires representation in significant commercial litigation cases.

With more than two decades of experience in employment law, Barry also advises clients and acts for them on fiduciary-related issues as well as wrongful dismissal cases. Recently, he successfully defended a case by former sales representatives alleging constructive dismissal and in another instance was successful in defending a former employee for breech of fiduciary duty.

Barry, whose court experience includes acting as counsel before all levels of court in Canada, has also appeared as counsel in arbitrations, mediations and before numerous tribunals.

His written work includes "Making a Legal Case for Job References" and The Legal Implications of Providing a Reference to a Former Employee", which discuss the legal implications surrounding employee references. Other publications include "Hiring and Firing Key Employees" and "Could You Be Liable If Your Ex-Employee Dies?".

As a lecturer, Barry presents papers to various legal and professional groups on employment and fiduciary-related issues. He has instructed in the Bar Admission Course (Civil Procedure and Advocacy) and lectured in continuing education programs sponsored by the Law Society of Upper Canada.
