Profile

A partner in Blaney McMurtry LLP, Mirilyn Sharp's practice focuses on her expertise in defending large-scale, class action law suits.

"My practice primarily is in the area of class actions," she says. "I'm currently involved in a number of them."

As an example, since 1994, she has represented a large pharmaceutical company in the defence of class actions brought by breast implant recipients in three Canadian provinces and was involved in negotiating settlements in Ontario, Quebec, and British Columbia. She also acted in defence of various class action claims brought by the Federal Government against manufacturers of breast implants. Mirilyn represented another large pharmaceutical company involved in a class action suit regarding the manufacture of a vaccine that allegedly caused neurological damage in children. She is currently defending a cross-Canada class action suit initiated against insurance companies for charging deductibles to their insureds.

Mirilyn handles professional liability claims as well, and, in particular, defends lawyers with respect to claims brought against them.

Mirilyn also advises insurers on coverage issues. "That includes advising insurance companies on whether persons being sued are covered under their existing policies," she says.

In addition, Mirilyn acts on a number of files involving general commercial litigation.

Mirilyn co-wrote with colleague Robert Potts "When All That Glitters Is Not Gold" for a special report on real estate fraud by LawPro, the Lawyers' Professional Indemnity Company. It outlines for lawyers the warning signs for fraudulent transactions in which they could be held complicit.
