Richard Krempulec, a senior partner at Blaney McMurtry LLP, practices litigation, specializing in insurance corporate and commercial disputes.
He completed the Harvard Law School course on arbitration and mediation and, in 1999, obtained his LL.M. in Alternative Dispute Resolution from Osgoode Hall Law School. "I took the Harvard course because it deals with the issue and process of settling disputes," Richard says. "I have acted as an arbitrator, but the whole process of mediation is to get two people who have a dispute to resolve that dispute through an agreement."
Richard adds that "by having an understanding of the mechanics of a dispute resolution process, the lawyer has a better chance of achieving a good settlement for his client. Once you understand the process, you know what's going on and you’re not confused by what’s happening."
Getting those disputes resolved, he says, "is most satisfying. You help people get on with their business rather than spending time in a court proceeding." Over the past two years he has successfully negotiated settlements on behalf of clients in many commercial and insurance disputes.
His extensive litigation experience involves cases dealing with property policies, boiler and machinery policies, professional liability, directors and officers, employment practices, and fiduciary policies. He also provides coverage opinions on those policies. Richard has been involved as counsel in a broad range of disputes in arbitrations, mediations, trials and appeals.
Richard has been a guest lecturer and judge at the Trial Advocacy Program at Osgoode Hall, he has made presentations on tactics and strategy in negotiation, trial, arbitration and mediation. He has given papers on property, professional liability, directors' and officers', property claims, and insurance issues at Lloyd's of London in the United Kingdom, the Canadian Institute, the Insurance Institute of Ontario, and the Law Society of Upper Canada.
Richard is the author of a looseleaf manual entitled "Property Damage Claims under Commercial Insurance Policies", which is published by Canada Law Book.
