 Overview

Mervyn has extensive experience in all aspects of commercial litigation (including disputes involving contracts, real estate, negligence, fiduciary obligations, as well as corporate, partnership, employment and shareholder disputes), as well as in commercial bankruptcy, insolvency and restructuring matters. He is certified by the Law Society of Ontario as a Specialist in both Civil Litigation and Bankruptcy and Insolvency Law, and appears regularly before all levels of the trial and appellate courts of Ontario.   

Mervyn is regularly consulted and retained by other law firms in Toronto, as well as across Canada and the United States, for his experience, expertise, and insights in commercial litigation and insolvency matters.

    • Acted for a manufacturer of service station fuel pump nozzles in an action involving a fire that destroyed a $1 million Porsche 918 Spyder automobile
    • Acted for the Chinese manufacturer of fire retardant clothing in its dispute with a Canadian distributor and involving a related action in the British Virgin Islands
    • Counsel to a national lessor of heavy equipment in its dispute with its customer regarding specialized excavation equipment used in the construction industry
    • Counsel to a national computer distributor in enforcing its claims against a Chinese manufacturer of drones and other technological equipment
    • Successful trial and appellate counsel to a national refrigeration manufacturer in its legal action against a transportation company for negligence and breach of contract
    • Counsel to a contractor in its dispute with a sub-contractor over work performed at a number of venues constructed for the Pan-American Games in Hamilton and Milton
    • Counsel to a condominium developer in Mississauga in its dispute with another condominium developer 
    • Counsel to a Toronto film production company in its action against its lawyers for negligent legal advice leading to the loss of valuable film rights 
    • Court-appointed representative counsel to a group of individuals in a large, commercial mortgage enforcement action involving the determination of their rights as life-lease holders
    • Counsel to an Ontario corporation in a multi-jurisdictional shareholder dispute with an Israeli corporation
    • Counsel to a U.S.-based Tier 1 automobile parts supplier in a dispute involving parts suppliers withholding tools and parts destined for several OEM's
    • Counsel to a pharmaceutical manufacturer in a breach of contract action with international scope involving the construction of custom equipment and several large foreign entities in Germany, Switzerland and the United States
  • Bankruptcy & Insolvency

    • Acted for the Canadian subsidiary of a Korean nanofiber manufacturing company in its proposal to its creditors
    • Acted for a UK-based book publisher with respect to the receivership of the University of Ottawa bookstore
    • Acted for the court-appointed liquidator of a company that owned a large rental apartment facility in Toronto
    • Acted for the head of a mortgage syndicate in seeking the appointment of a receiver over a large townhouse complex
    • Successful trial counsel on behalf of a creditor in a hybrid bankruptcy trial that resulted in the disallowance of another creditor’s large trust claim
    • Counsel to the Monitor in the court-ordered winding up of a corporation involved in blockchain and cryptocurrencies investments
    • Counsel to a Chinese toy manufacturer / supplier in the Toys R Us CCAA proceeding
    • Counsel to Martin Ross Group Inc., a jewellery manufacturer, in its CCAA filling
    • Counsel to a Taiwanese creditor in the Comark Canada CCAA filing
    • Counsel to the U.S. purchaser of several claims of various Canadian and international creditors of Target Canada in its CCAA filing 
    • Counsel to creditors, nationally and internationally, in the cross-border CCAA restructurings of Vallefoam, Canwest, Angiotech
    • Counsel to various secured and unsecured creditors in several court-appointed receiverships and bankruptcies in the high-tech and biotech spheres, including Botaneco, Seven Group Data Management Group, Sprint Network, Gloplug and others
    • Counsel to several trustees and receivers dealing with various Ponzi schemes and other fraudulent transactions
    • Counsel to several statutory and court-appointed receivers in southern Ontario in the social housing area
