Application for Bifurcated Trial on Child Support Issues Successfully Defended

Judy Piafsky has won a significant victory before Madam Justice Backhouse in the Ontario Superior Court of Justice in the case of Tom Baker v. Monica Francis. Acting for the Respondent mother, Monica Francis, against her former husband Tom Baker, the Applicant father, on his motion to have a bifurcated trial on issues relating to child support, Ms. Piafsky was successful in having the application denied.  A loss would likely have mired the case in endless litigation which as noted by the judge, would have been financially burdensome to Ms. Francis, although not so for Mr. Baker. There has been a noticeable increase in requests for bifurcated trials in family law matters and this decision will likely receive significant judicial consideration in the months to come.
